Terms of Use

Article 1 (Purpose)
These terms and conditions were created to establish the rights, obligations, responsibilities, and procedures between the service provider and members when using the Simkung ilji service provided by Beatory (hereinafter referred to as ‘Service Provider’).

Article 2 (Definition)
In these Terms and Conditions, terms are defined and used as follows.
1. “Service” refers to all related services provided by the service provider through the member’s terminal (including various wired and wireless devices such as mobile phones and tablet PCs).
2. “Member” refers to customers who use the Service by accessing the Service and entering into a service agreement with the Service Provider in accordance with these Terms and Conditions.
3. “ID” is the SNS account used by the member to identify the member and provide services.
4. “Tokens” are service data that members pay to record their Simkung and can be obtained by watching advertisements, etc.

Article 3 (Posting and revision of terms and conditions)
1. These terms and conditions are posted on the app and website so that members can easily check them.
2. The service provider may, as necessary, revise these terms and conditions to the extent that they do not violate relevant laws such as the “Act on the Regulation of Terms and Conditions” and the “Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.”

Article 4 (Interpretation of Terms and Conditions)
1. Matters or interpretations not specified in these Terms and Conditions shall be governed by relevant laws and regulations or commercial practices.
2. The service provider may have separate terms of use or policies (hereinafter “separate terms and conditions”) for individual services within Vitori, and if the contents conflict with these terms and conditions, the separate terms and conditions will take precedence.

Article 5 (Conclusion of Use Agreement)
1. A service use agreement is concluded when a person who wishes to become a member (hereinafter referred to as “membership applicant”) agrees to the terms and conditions, applies for membership, and the service provider accepts it. If necessary, the service provider may request real name verification and identity verification through an identity verification agency.
2. Applicants must provide truthful information when applying for membership, and any disadvantages and legal liability resulting from providing false information lie with the applicant.
3. If the applicant has previously lost membership, used a false name or someone else's name, or if there are other reasons why approval is not possible, approval may be denied.
4. The service provider may withhold approval for service-related facility availability or other technical or business reasons, and will notify the applicant of the result.

Article 6 (Change of member information)
1. Members can view and modify their personal information through the service screen.
2. If there is a change in the member information provided at the time of application for membership, the service provider is not responsible for any disadvantages resulting from failure to correct it.

Article 7 (Service Contents)
The Simkung ilji service is an application that measures and records and stores biometric indicators such as heart rate with a wearable device.
1. The basic contents of the services provided by service providers to members are as follows.
i. Biometric indicators such as heart rate are provided in chart or indicator format
ii. Provides the ability to edit biomarkers with photos, etc.
iii. Provides the ability to share biomarkers with users' acquaintances
2. Members can inquire about more detailed service details through ‘Contact us by email’ within the app.
3. In order to provide smooth service, the service provider may provide advertisements and service-related information to members through email or SMS. If you do not wish to receive them, you can unsubscribe at any time.

Article 8 (Change of Service)
1. The service provider may change all or part of the service it provides depending on operational or technical needs, and will not provide separate compensation to members for this, unless otherwise stipulated in the terms and conditions.
2. If the service is changed, the reason for the change, date, and details of the change will be announced on the notice board 7 days prior to the change. However, if it is difficult to specifically notify the reason or content of the change, the reason will be disclosed.

Article 9 (Temporary suspension of service)
1. The service provider may temporarily suspend the provision of the service for technical or business reasons, such as maintenance inspection, replacement or breakdown of service-related equipment, or communication interruption. In this case, in principle, notification is provided in advance, but if unavoidable reasons exist, notification may be made after the fact.
2. Temporary suspension of service will be notified by email, notice within the service, or posting on the service website.
3. If a member incurs a loss due to an interruption, the service provider may compensate by providing tokens, etc., within the normally foreseeable range. However, compensation will not be provided in cases of force majeure such as natural disasters.

Article 10 (Member’s contract termination, request for suspension of use, etc.)
1. Members can withdraw their membership at any time by withdrawing membership within the app (Settings > User Profile > Membership Withdraw icon).
2. Upon withdrawal of membership, member information on the server and information backed up by the member on the server are also deleted.
3. The service provider is not responsible for any damage incurred by a member due to deletion of information backed up by the member on the server due to membership withdrawal.

Article 11 (Service provider contract termination, use restrictions, etc.)
1. In the following cases, the service provider may terminate the service agreement with the member without prior notice and result in loss of membership.
i. If a member dies
ii. In case of stealing another person's personal information or mobile device
iii. If the personal information provided by the member when signing up is found to be false
iv. If it threatens the electronic transaction order, such as interfering with other members’ use of the service.
v. When impersonating a service provider, operator, employee, etc. outside of the service
vi. If you threaten the system by unauthorizedly changing the service provider's client program or hacking the server.
vii. In case of damaging the reputation or credibility of the service provider or interfering with the business by spreading false information or using other hierarchical methods.
viii. When engaging in spam-like promotional activities regarding the service우
ix. In case of other acts that violate obligations under these Terms and Conditions or laws
2. The personal information of a member who has been notified of disqualification for reasons ii to ix above will be deleted immediately upon notification, and the member will not be able to raise an objection.
3. If the above reasons exist, the service provider may impose restrictions on use instead of disqualification.

Article 12 (Member ID and password)
1. Responsibility for managing member ID and password lies with the member, and members must not disclose or allow their ID and password to be used by a third party.
2. The service provider does not store member ID and password at all. Therefore, the service provider is not responsible for any disadvantages caused by a member's ID or password being stolen.

Article 13 (Service Provider Obligations)
1. The service provider does not violate relevant laws or these Terms and Conditions and does its best to provide continuous and stable services.
2. Service providers must have a security system to protect members' personal information, including credit information, and will disclose and comply with the personal information handling policy.
3. The service provider must process the member's opinions or complaints related to the use of the service if it deems them to be legitimate. The processed results will be notified to members through the bulletin board or email.

Article 14 (Member's Obligations)
Members must not engage in any of the following acts in connection with the use of the service.
i. Registration of false information when applying for or making changes related to service use
ii. Damage such as unauthorized alteration, deletion, etc. of various information posted within the service
iii. Any act of disassembling, changing, or imitating the service through any processing.
iv. Acts that infringe the rights, including intellectual property rights, of service providers or other third parties.
v. Collecting personal information or damaging the reputation of other members
vi. Transmitting advertisements or exposing obscene or violent information without the consent of the service provider
vii. Non-compliance with other obligations under the Terms and Conditions
viii. Other illegal and unfair actions

Article 15 (Attribution of copyright and restrictions on use)
1. Rights such as intellectual property rights related to the service provider's trademark, logo, services provided, and advertising content belong to the service provider.
2. Members must not use the information obtained by using the service for commercial purposes or allow a third party to use the information obtained through the use of the service by copying, transmitting, publishing, distributing, broadcasting or other methods without the prior consent of the service provider.

Article 16 (Resolution of service-related disputes)
1. The service provider promptly handles member comments or complaints related to service use. However, if prompt processing is difficult, we will notify you of the reason and processing schedule.
2. Disputes that arise between service providers and members can be resolved through the mediation procedures of the Electronic Commerce Dispute Mediation Committee established by the Framework Act on Electronic Commerce.

Article 17 (Termination of Service)
1. The service provider will notify the member at least one month prior to the date of termination of the service, if possible.
2. Some portions of the Service may be restricted from the date of termination notice until the date of service termination.

Article 18 (Governing Law and Jurisdiction by Agreement)
1. Legal disputes raised between service providers and members will be governed by the laws of the Republic of Korea.
2. Lawsuits regarding disputes arising between service providers and members shall be filed in the Seoul Central District Court.

Article 19 (Personal Information Protection Obligation)
1. The service provider strives to protect personal information, including member registration information, in accordance with relevant laws and regulations.
2. This is in accordance with relevant laws and the service provider's “Privacy Policy,” and is announced on the website so that members can always check.

Supplementary provisions
1. These terms and conditions apply from November 25, 2023.

Simkung ilji Privacy Policy

  Privacy Policy Beatory (hereinafter referred to as ‘Service Provider’) establishes and discloses the personal information processing policy as follows in order to protect members’ personal information and handle related complaints quickly and smoothly in accordance with personal information protection laws. Chapter 1 Purpose of processing personal information Service providers process personal information for the following purposes. The personal information being processed will not be used for purposes other than the following, and if the purpose of use changes, necessary measures will be taken, such as obtaining separate consent in accordance with Article 18 of the Personal Information Protection Act.  1. Membership registration and management Personal information is processed for the purposes of confirming intention to become a member, identifying and authenticating oneself in accordance with the provision of membership services, maintaining and managing membership qualifications,
